Terms and Conditions for Registration and Deposits
1. Deposit Requirement:
To participate in the Rospa Imports auction, all bidders are required to place a refundable deposit. This deposit serves as a commitment to bid and ensures serious participation in the auction.
2. Deposit Refunds:
– *Unsuccessful Bidders:* If your bid is unsuccessful, the deposit will be refunded within 7 days after the auction closes.
– *Non-bidders:* If you register but do not place any bids during the auction, your deposit will also be refunded within 7 days after the auction closes.
– *Successful Bidders:* If you are the winning bidder, the deposit will be applied towards the final purchase price of the vehicle.
3. Payment Method:

4. Registration Process:
Registration will only be confirmed upon receipt of the deposit. If the deposit is not received in time, your registration may be invalid, and you will not be able to participate in the auction.
5. Non-Refundable Circumstances:
Rospa Imports reserves the right to withhold the deposit if there is a breach of auction rules or if fraudulent activity is suspected.
General Auction Terms and Conditions*
1. Vehicle Condition:
All vehicles are sold “as is.” While Rospa Imports will provide registered bidders with all available information, reports, and history on each vehicle, no guarantees or warranties are made regarding the condition, quality, or suitability of the vehicles. Bidders are encouraged to conduct their own inspections where possible.
2. Auctioneer’s Discretion:
The auctioneer reserves the right to accept or reject any bids. The highest bid accepted by the auctioneer at the fall of the hammer is considered the winning bid. Once the hammer falls, no further bids will be accepted.
3. No Liability:
Rospa Imports, its owners, staff, and contractors, cannot be held liable for any loss, damage, or injury incurred by bidders or buyers during the auction or afterward. By participating, bidders agree that they accept all risks associated with the purchase of vehicles through this auction.
4. Legal Compliance:
This auction is conducted in accordance with the relevant South African laws and regulations. All bidders must comply with these laws and any other conditions set forth by Rospa Imports.
5. Ownership Transfer:
The successful bidder will be responsible for all transfer fees, taxes, and duties associated with the purchase and registration of the vehicle in South Africa.
6. Dispute Resolution:
Any disputes arising from the auction will be subject to mediation. If mediation fails, the dispute will be settled by arbitration under South African law.
7. Right to Amend:
Rospa Imports reserves the right to amend or update these terms and conditions at any time without prior notice. All registered bidders will be notified of any significant changes.
8. Participation:
By registering and participating in the auction, you agree to these terms and conditions. Failure to comply with the auction rules may result in disqualification and forfeiture of any deposits.
